Below you will find highlights of our most commonly requested Bylaws.

Buying/Selling Property

  • Utilities– Seller – Have you informed the office of your last possession date?

    – Buyer – Have you informed the office of your possession date?

  • Taxes – Are they paid?
  • Lawyers usually adjust tax amounts owing by each party and include this amount in the purchase/selling prices. They generally do not pay the outstanding tax amount to the Municipality. That is the responsibility of the current name(s) listed on the Land Title.
    Change in ownership of buildings without the land (i.e. manufactured homes) has to be reported to the Village Office with a copy of the bill of sale. (These transactions do not go through Land Titles).

TAX DUE DATES

Taxes for the Village of Linden are due on or before July 31st, a penalty of 12% shall be applied on August 1st for any outstanding current amount. Additional penalties of 6% are applied on October 1st on current amounts and 18% on January 1st for all outstanding amounts.

TAX INSTALLMENT PLAN

The Village has a Tax Installment Plan available. The plan divides the taxes into 12 equal installments from January to December. No tax penalties are applied as long as the payments are kept current. Contact the Village Office for more information.

WATER/SEWER/GARBAGE RATES AND BILLING PERIODS

Water/Sewer/Garbage is billed every 2 months (January-February. March-April, May-June, July-August, September-October, November-December). Billing is for previous 2 months usage. (e.g. use for July and August is billed August 30) and is due and payable when received by the addressee. Bills not paid by the 20th of the following month are assessed a 2.5% penalty and a shutoff notice is mailed. If you are a property owner and this bill remains unpaid the outstanding amount may be applied to your tax account. Owners on the tax installment payment plan would then be in arrears and liable for any penalty.

NEW RENTER

According to our utility bylaw renters are required to provide the Village Office with a deposit of $150.00 prior to service being provided to the residence. This deposit will remain in trust with the Village until such time that the Utility Account is closed, and all outstanding balances are cleared.

GARBAGE DISPOSAL

Residential garbage pickup is on Friday, except residents west of the Coulee, which is picked up Thursday with Commercial garbage. Please place garbage in proper bags. No more than 30 lbs. per bag. No more than 6 bags per household. Garbage must be in animal proof containers.
Transfer site hours of operation:
Tuesday and Thursday – 10:00 a.m. to 6:00 p.m.
Saturday 9:00 a.m. to 5:00 p.m.

SIDEWALKS

The removal of snow, ice or debris from the sidewalk adjoining your property is the responsibility of, and at the expense of, the registered owner of the property.

NOISE BYLAW

No person shall make, cause or continue to make any loud, unnecessary or unusual noise or any noise whatsoever which either annoys, disturbs, injures, endangers or detracts from the comfort, repose, health, peace or safety of other persons within the limits of the Village.

UNSIGHTLY PREMISES BYLAW

General Prohibition
3.1 No owner or owners of a premise shall cause, allow or permit the premises to become or to continue to be an Unsightly Premises as defined in this Bylaw.
3.2 The questions of whether or not a particular premises exhibits “visual evidence of a lack of general maintenance, clean-up and upkeep”, or whether there is an “excessive accumulation” of the materials listed in Section 2.1.20 of this Bylaw, are questions of fact to be determined by a Court hearing a prosecution pursuant to the provisions of this Bylaw.
3.3 When making the determination during a trial as to whether a person is guilty of an offence under Section 3.1 of this Bylaw, the Court’s considerations shall include any admissible evidence as to:
a) The general condition and state of tidiness of the neighboring or surrounding premises; and
b) The location and permitted use of the premises and whether or not the premises is located within a Residential Development; and
c) The period of time the premises has been in the state complained of; and
d) Whether or not the premises is undergoing construction or renovation, and the period of time that such activity has been ongoing; and
e) Any other circumstances or facts relating to the premises that the Court deems are relevant to the said determination.
3.4 Every owner or occupier of a premise shall ensure that graffiti placed on the premises is removed, painted over, or otherwise permanently blocked from public view within 14 days of the owner becoming aware or notified of the presence of said graffiti.
WEEDS, GRASS, TREES, PESTS AND SMOKE
4.1 Every occupant or owner of any property or premises within the Village shall:
a) Eradicate or control all weeds on the premises, and on any boulevard which abuts or adjoins the premises, including up to the center of lanes or alleys at the rear or side of the premises;
b) Prune or remove any and all trees located on the premises that, due to a deterioration of condition or for any other reason, interfere with any public utility or public works, and are a public safety hazard;
c) Remove or prune any shrub located on the premises which is, or could be, a nuisance to any person using any publicly owned or maintained sidewalk or street;
d) Prevent unnecessary stagnant water from remaining on the premises so as to avoid it becoming a potential breeding place for mosquitoes or other pests;
e) Cut or mow the grass on any boulevard or street, situated on Village owned land adjoining, or abutting or adjacent to the premises owned or occupied by him, to prevent such grass from growing to such a height as to be unsightly, having regard to the height of the grass on adjacent or surrounding premises;
f) Remove from such property any dead grass or brush or rubbish which is clearly untidy or unsightly, or which may harbor vermin or pests therein;
g) Cut or mow the grass on such property before said grass reaches such a height as to be unsightly, having regard to the height of the grass on adjacent or surrounding property.
4.2 No occupant or owner of any property or premises, whether presently occupied or not, shall:
a) Allow weeds to grow and propagate uncontrolled or excessively on the premises;
b) Suffer or permit trees, or other vegetation growing on the property to interfere or endanger the lines, poles, conduits, pipes, sewers or other works of the Village ;
c) Allow any infectious blight or disease of the trees or other vegetation located on the property to go uncontrolled or unchecked;
d) Allow, permit or cause any opaque or dense smoke or dust to be emitted to the atmosphere from the premises.
CONSTRUCTION SITES
5.1 An owner of a property or premises under construction shall ensure that building materials and waste materials on the premises are removed or contained and secured in such a manner that prevents such material from being blown off or scattered from the property.
5.2 An owner of a property or premises under construction shall ensure that waste building material on the premises is removed or secured within a reasonable time by means of appropriate containers.

DOG LICENSING

All dogs over the age of 3 months must be licensed. Cost of a license is $40.00 for male or female; $20.00 for neutered male or spayed female for January 1st to December 31st of each year. You must obtain the annual license on or before the first day when the Village of Linden office is open for business in February, in every year; any unlicensed by this date will be ticketed by our Bylaw Officer. You must obtain a dog license within the first two weeks of purchasing, bringing into the Village or becoming in possession of any dog, or in the first two weeks of becoming a new resident of the Village of Linden. The burden of proof that the dog is not the property of the said owner shall rest upon the said owner. The Bylaw Officer may issue tickets for a variety of infractions; you are responsible for your animal. Dogs must be kept on a leash at all times when off the owners property.

DEVELOPMENT & BUILDING PERMITS

If you are planning to:

  • Construct any type of building, regardless of size or use;
  • Develop any property;
  • Make additions/renovations to an existing structure;
  • Erect a sign.

REMEMBER:

Contact the Village Office, as you will need a development/and or building permit plus inspection requirements information. There are some requirements that must be met, so allow plenty of time for approval.
Any development or construction that takes place before approval is granted, is done at the owners/developers own risk and may constitute a stop work order.

  • Applications received a minimum of two weeks prior to the initial start date - $25.00
  • Applications received less than two weeks prior to the initial start date - $50.00
  • Applications received after the initial start date - $200

Our Land Use Bylaw and Municipal Development Plan provide guidelines and specific requirements for all development in our community. Contact the office regarding any and all development that you are considering.

BUSINESS PERMITS

If you are planning to:

  • Start a business in the Village;
  • Start a home business;
  • Change the use of an existing business.

REMEMBER:

Contact the Village Office, as you will need a business permit form. There are some requirements that must be met, so allow plenty of time for approval. Permit fee is $25.00 per application fee. This is a one-time fee.

RECOGNITION CERTIFICATES

The Village presents recognition certificates to individuals celebrating milestone birthdays or anniversaries. If you know of someone celebrating one of the above, please advise the Village Staff at least one week prior to the event.

HAWKERS AND PEDDLERS

The Village requires that all door-to-door sales people purchase a business license. If someone comes to your door, ask to see their license (Linden License not Provincial). If they cannot produce one, call the Village Office immediately. Fee – $15.00 a month or $60.00 a year.

INFORMATION FOR MANUFACTURED HOMES OWNERS

It is the owner’s responsibility to ensure skirting is securely in place, pipes are insulated, and heat tapes are installed and working.
